What should we remember?
- Before reporting the complaint to ADR, first submit a complaint at the entrepreneur's
- Compare fee for arbitration or mediation to the costs of court mode.
- In ADR systems, the cases are most often conducted in a written mode; in court proceeding you will have an opportunity to submit explanations orally,
- The settlement in ADR system may make impossible to conduct a proceeding before civilian court in the same case.
- The settlements in ADR system most often don't have an enforcement power and therefore you will have to apply to the court for granting enforcement clause; the submission of such an application most often requires incurring the court fee.
